Refund Policy

Effective Date: March 18, 2026

Billing and refunds at a glance

Use this checklist before starting a trial or changing a subscription.

  • Self-serve plans begin with a seven-day paid trial and require a valid payment method.
  • Cancel before the trial ends to prevent the selected plan from renewing automatically.
  • Payments are generally non-refundable except where the policy below or applicable law requires otherwise.

This Refund Policy explains how KOENZIM LLC ("KOENZIM," "we," "us," or "our") handles free trials, subscription cancellations, refunds, credits, promotions, payment disputes, and related billing matters for Creagency.ai and the Creagency application available at app.creagency.ai (collectively, the "Service").

By starting a free trial, purchasing a subscription, paying an invoice, or otherwise making a payment for the Service, you agree to this Refund Policy.

This Refund Policy forms part of our Terms of Service and should be read together with any applicable order form, subscription flow, checkout disclosures, or other written agreement governing your use of the Service.

1. Scope and Billing Model

Creagency is a subscription-based digital service. We currently offer:

  • monthly subscriptions;
  • yearly subscriptions; and
  • enterprise or custom plans governed by separate written agreements.

Subscriptions are generally managed at the workspace level. The workspace owner, billing contact, or another authorized representative designated by us or by written agreement is responsible for billing actions related to that workspace.

2. Free Trial Terms

2.1 Trial Offer

Creagency may offer an eligible new customer a 7-day free trial. A valid payment method is required to start the trial.

2.2 Automatic Conversion

Unless canceled before the trial ends, the trial will automatically convert into the paid plan selected at signup and the applicable subscription fee will be charged when the trial ends. A user may also choose to begin the paid subscription immediately before the end of the trial.

2.3 Trial Reminders

We may send reminder emails or other notices before a trial ends. However, failure to see, receive, read, or act on a reminder does not create a right to a refund if the subscription renews or converts as disclosed.

2.4 Immediate Access to Digital Services

By starting a trial or paid subscription, you request immediate access to the Service. Where required by applicable law, we may ask you during checkout to expressly:

  • consent to the Service starting immediately;
  • acknowledge that you will receive immediate access to digital features; and
  • acknowledge that, to the extent permitted by law, any cooling-off period, right of withdrawal, or similar cancellation right may be reduced, waived, or lost once performance begins.

2.5 Trial Eligibility and Abuse Prevention

Free trials are offered for evaluation purposes only. We may limit, deny, shorten, revoke, or refuse any trial or promotional offer where we reasonably suspect abuse, misuse, duplication, fraud, or attempts to bypass eligibility rules.

To the maximum extent permitted by law, we may treat a trial as ineligible if it appears associated with the same or related:

person; email address; phone number (if provided); payment method; organization; device; browser or technical identifier; IP address; account; or workspace.

3. How Cancellation Works

3.1 Cancellation Methods

Users may cancel through one or more of the following methods made available by us:

  • self-serve billing settings in the Service;
  • the Stripe customer portal; or
  • by contacting [email protected].

3.2 Cancel Before Renewal

To avoid the next renewal charge, you must cancel before the renewal date or, in the case of a trial, before the 7-day trial ends.

3.3 Effect of Cancellation

Unless otherwise stated in the Service, at checkout, or in a separate written agreement:

  • cancellation stops future renewals;
  • cancellation does not reverse or refund charges already incurred;
  • cancellation may take effect immediately or at the end of the current billing period, depending on the option presented to you or approved by us; and
  • choosing or receiving immediate cancellation does not create a refund right for unused time.

3.4 Monthly Plans

For monthly subscriptions, cancellation generally applies to the remainder of the current monthly billing period, unless an immediate cancellation option is provided or approved. No prorated refund is owed for unused days of a monthly billing cycle unless required by law or expressly approved by us in writing.

3.5 Yearly Plans

For yearly subscriptions, cancellation prevents the next annual renewal unless otherwise specified. Except where required by law or expressly approved by us in writing, yearly fees are not refundable or proratable after the applicable charge has been processed.

3.6 Enterprise and Custom Contracts

Enterprise and custom plans are governed by the applicable order form, invoice terms, or separate written agreement. Unless that written agreement expressly states otherwise:

  • enterprise commitments are non-cancellable during the committed term;
  • enterprise payments are non-refundable; and
  • any invoice paid by ACH, wire, or other manual payment method is final.

4. General No-Refund Rule

All fees are non-refundable except where required by law or where we expressly approve a refund in writing.

To the maximum extent permitted by law, this means:

  • no refunds for unused time;
  • no refunds for partial billing periods;
  • no refunds for downgrades or reduced usage;
  • no refunds because you forgot to cancel before renewal;
  • no refunds because you changed your mind after purchase;
  • no refunds because you did not fully use the Service; and
  • no refunds for fees already paid for a billing period that has started.

Any discretionary exception we grant is a one-time courtesy and does not obligate us to grant the same or similar exception in the future.

5. Narrow Exceptions We May Approve

Although our default rule is no refunds, we may review and approve a refund, partial refund, prorated refund, service credit, trial extension, or other billing adjustment in very limited situations such as:

  1. Duplicate charge or accidental duplicate subscription.
  2. Billing error caused by us.
  3. Charge after timely and valid cancellation.
  4. Proven unauthorized or fraudulent charge, subject to investigation and verification.
  5. Verified platform-wide outage caused by us that materially prevented access to core paid functionality for a meaningful period.
  6. Verified reproducible defect in the Service that materially prevented core paid functionality, but only where:
    • support confirms the issue is reproducible and caused by our Service;
    • the request is made within 2 days of the first paid charge; and
    • there has been no meaningful use of the Service.
  7. Same-day initial charge review for a newly converted or newly purchased subscription where:
    • the account or workspace has not meaningfully used the Service; and
    • no AI credits, paid AI usage, or materially equivalent paid resources have been consumed.

Any such exception is entirely at our discretion unless applicable law requires otherwise.

6. Meaningful Use of the Service

For refund review purposes, an account or workspace is generally considered to have meaningfully used the Service if you or anyone acting through your workspace has done one or more of the following after the relevant charge or during the relevant paid access period:

  • scheduled or published posts;
  • uploaded, stored, organized, or reused assets;
  • generated, edited, or exported AI-assisted content;
  • invited, added, or managed team members;
  • used analytics, reports, dashboards, or export features;
  • consumed AI credits or paid AI-related usage;
  • connected or actively used third-party platform integrations; or
  • otherwise made substantial use of paid features, limits, storage, automation, or collaboration tools.

Use by any workspace member, collaborator, contractor, or invited teammate may be treated as use by the subscribing workspace.

Once there has been meaningful use, refunds will ordinarily be denied except where required by law.

7. Situations That Are Not Refundable

Without limiting the general no-refund rule, the following do not qualify for a refund, credit, or cancellation reversal merely because they occurred:

  • you changed your mind;
  • you no longer need the Service;
  • you forgot to cancel before renewal;
  • you did not use the Service enough or at all;
  • you were dissatisfied with features, workflow, design, roadmap, or subjective experience;
  • you expected business, audience, growth, revenue, engagement, or marketing results that did not occur;
  • AI-generated output was unsatisfactory, inaccurate, incomplete, stylistically different than expected, or required further editing;
  • a connected social platform throttled, rejected, delayed, rate-limited, reviewed, flagged, limited, suspended, or removed content or account access;
  • a social platform changed its API, permissions, rate limits, policies, publishing rules, or technical requirements;
  • your own social media account, domain, email, device, browser, network, or third-party tools caused access or performance issues;
  • token expiry, credential issues, platform moderation, or account restrictions impacted posting or analytics;
  • you downgraded, reduced seats, reduced usage, or deleted content mid-cycle; or
  • you failed to comply with published onboarding, technical, or account requirements.

For the avoidance of doubt, we do not guarantee virality, follower growth, reach, impressions, monetization, engagement, or approval by third-party platforms.

8. Suspensions, Terminations, Abuse, and Fraud

8.1 No Refund for Violations or Abuse

If we suspend, restrict, or terminate an account or workspace because of an actual or suspected violation of our Terms, policies, or applicable law, you will not be entitled to a refund, credit, restoration, or compensation except where required by law.

This includes, without limitation:

  • spam or abusive behavior;
  • abusive automation or misuse of platform features;
  • trial abuse or multi-account abuse;
  • fraudulent, deceptive, or manipulative conduct;
  • use of a fake, stolen, or unauthorized payment method;
  • chargeback abuse or bad-faith disputes; or
  • attempts to evade plan limits, billing restrictions, moderation, or enforcement actions.

8.2 Fraud Screening and Review

We may investigate payments, subscriptions, cancellations, trials, and refund requests to detect fraud, abuse, or manipulation. We may delay, deny, or reverse access while we investigate.

8.3 Audit and Evidence Records

We may retain and rely on account records, login history, billing logs, audit trails, workspace activity, support communications, publishing records, analytics access, IP/device information, and processor responses when reviewing refund requests or payment disputes.

9. Chargebacks and Payment Disputes

Please contact [email protected] before opening a chargeback or payment dispute if you believe a charge is incorrect.

If you initiate a chargeback or payment dispute, we may, to the maximum extent permitted by law:

  • suspend or restrict the associated account or workspace while the matter is investigated;
  • revoke access to paid features or future renewals;
  • deny future trials, subscriptions, or service access;
  • submit relevant records and evidence to Stripe, banks, card networks, or other payment processors; and
  • seek recovery of fees, costs, and losses associated with fraudulent or bad-faith disputes where lawful.

A successful chargeback does not automatically entitle you to continue using the Service.

10. Promotions, Discounts, Credits, and Trial Extensions

Unless expressly stated otherwise in writing:

  • promotional pricing, launch offers, influencer discounts, coupons, and discount codes are non-refundable;
  • promotions are non-retroactive and cannot be applied to prior charges;
  • promotions are not redeemable for cash;
  • promotions are limited to the scope, time, plan, and conditions stated in the offer; and
  • promotions may be one-time use only.

Any account credits, service credits, courtesy credits, trial extensions, promotional balances, or similar adjustments:

  • are granted solely at our discretion unless otherwise required by law;
  • are non-transferable;
  • are non-refundable;
  • are not redeemable for cash; and
  • may expire 12 months after issuance unless a different expiration date is stated in writing or required by law.

11. Taxes, Processor Fees, FX, and Banking Costs

To the maximum extent permitted by law:

  • taxes, duties, levies, and similar governmental charges are non-refundable except where legally required;
  • foreign exchange charges, bank fees, wire fees, card issuer fees, and similar third-party charges are non-refundable;
  • you are responsible for any currency conversion or banking costs charged by your payment provider; and
  • any approved refund will be sent only to the original payment method through Stripe or, for non-Stripe enterprise payments, through the payment route we determine is appropriate.

12. How to Request a Refund Review

If you believe your charge qualifies for review under this Refund Policy, you must contact [email protected] within 7 days of the charge date.

Your request should include, where available:

  • the billing contact email address;
  • workspace name or workspace identifier;
  • invoice number or charge details;
  • the date and amount of the charge;
  • the reason for the request; and
  • any supporting evidence reasonably requested by us.

We may deny requests that are:

  • submitted late;
  • incomplete or unsupported;
  • abusive, repetitive, or fraudulent; or
  • inconsistent with this Refund Policy, our records, or applicable law.

Approved refunds, if any, may take additional time to appear depending on Stripe, banks, card networks, and your payment provider.

13. Mandatory Consumer Rights

Nothing in this Refund Policy is intended to limit, waive, or exclude any consumer rights that cannot lawfully be limited, waived, or excluded under applicable law.

If the law of your country, state, province, or territory gives you non-waivable cancellation, withdrawal, refund, reversal, repair, replacement, or other consumer rights, those rights will apply to the extent required by law.

Where applicable law requires us to obtain express consent and acknowledgement before you lose any cooling-off, withdrawal, or similar right for digital services that begin immediately, we intend to do so at checkout and in related contract confirmations.

14. Governing Law; Separate Agreements Control

This Refund Policy is governed by the laws of the State of South Dakota, USA, without regard to conflict-of-law rules, except to the extent mandatory consumer protection laws require otherwise.

If you are on an enterprise or custom plan and your signed order form, MSA, or other written agreement conflicts with this Refund Policy, the written agreement will control for the matters it covers.

15. Changes to This Policy

We may update this Refund Policy from time to time. The updated version will be posted with a revised effective date. Changes apply prospectively unless otherwise required by law.
